00:05:45: And this is all about Shinjuku Ward in Tokyo and the surprise announcement that they've just released about strictly clamping down on short-term stay operations in the
00:05:55: municipality.".
00:05:56: So what brought this massive change?
00:06:00: What will it actually entail?
00:06:01: Who's going be affected?
00:06:04: if anything, and why?
00:06:06: we believe that Airbnb are failing a bit or maybe more than a bit in their job of supporting their hosts not just on this occasion but across the board.
00:06:15: That led us to a conversation about how to be a good host and help elevate the sector instead of being a bad host and harming it?
00:06:21: How to choose the right guest profile for your property.
00:06:26: We run through a brief history of short term stay regulations and restrictions in Japan, zoning licensing registration.

00:06:33: how to handle management and contact person requirements properly.

00:06:59: I'm just about to publish our last chat when we did the official announcement of these summit and i thought We're gonna talk more About this summit.
00:07:07: but uh...we've got some news coming In from Tokyo over To you Tracy
00:07:13: Shinjuku.
00:07:14: Well look You know, everyone's up in arms at the moment.
00:07:17: Like obviously it's hit the news and I've got a bunch of owners that are like you know writing to me.
00:07:24: so there Of course It's a lot of...it's a proposal At this point but as Emile quite rightly says its hit-its Hit The News.
00:07:34: So It's going to go ahead in some form.
00:07:40: If they remove the gag on their journalists, it is probably already happening right?
00:07:43: Exactly!
00:07:44: So what the proposal is?
00:07:46: that in purely residential zones – so non-commercial and mixed commercial – and in the residential zone, the Minpaku Law in Shinjuku weekends only anyway, so it's only Friday to Monday and or its monthly rentals.
00:08:11: So they're saying that their gonna revoke those um...and go from about three thousand.
00:08:16: I don't know what the numbers are in the news..so three-thousand odd listings of at two-thouse of those will be in Shinjuku will disappear ,will not be available.
00:08:26: .So In October there going to be hearing listening And then with a final decision coming into place next year, sometime.
00:08:38: So it's not happening immediately but of course you know as soon that hit the news all over Reddit and everyone is like It will be banned tomorrow.
00:08:49: Well no!
00:08:50: Its going to ban tomorrow But its challenging.
00:08:57: If your got an active business there than you're gonna get hit right?
00:09:02: Potentially yes, and what I mean?
00:09:04: look to be fair.
00:09:04: There's there's a lot of ways to Look at it.
00:09:06: There are a lot Of bad hosts out that i get It right?
00:09:09: They're some really dodgy actors Out there who Are giving people Who were not dodgy Me.
00:09:15: i think you put me in That category.
00:09:16: i would Put myself In the non-dodgy character Category.
00:09:19: um give all of us A bad name.
00:09:21: so those Bad Actors are Really Forcing The majority of the complaints that have been Going from the community To to the Hockenjo and, I think there's some pretty bad behaviour that has been happening.
00:09:40: When you say bad behaviour just give people context.
00:09:42: if they're not living here what does it mean from a Japanese neighbour perspective?
00:09:48: People standing out like a host who will let guests stand in front of their house smoking that haven't sorted the trash in a correct way.
00:09:58: Trash, of course is just so important here.
00:10:02: Guests who are noisy and walking up or down the street with suitcases looking foreign... And people are nervous if they don't know somebody whose in this area.
00:10:21: That's enough to be concerned.
00:10:23: That's on the host though.
00:10:24: The hosts really needs to be getting buy-in from their neighbors, they need to be you know knocking on the doors making sure that they're introduced and if there is any bad behavior then it needs to get handled by the host before Guests need to be educated guests.
00:10:48: Need to have some pretty good boundaries on them.
00:10:51: if they're They need to know that when there's staying in a residential area There is Community responsibility gets part of Japanese culture.
00:11:01: And if the hosts are not educating The guest and just letting them run amok and letting them you know cause Problems in their neighborhood, but I'm the host um yeah so i get it.
00:11:16: But to have this sort of knee-jerk blanket ban rather than say, rather then identify the ones that are doing well or all the properties where neighbors is okay and really just digging into you know, individual problems rather than just saying oh this is all too hard to deal with we're going get rid of them.
00:11:42: I have read from the municipality that they said that they had been handling complaints individually and they have revoked some licenses but it didn't work well enough anyway.
00:12:01: Right now in Shinjuku so with zoning there's residential, like this commercial industrial different grades of it.
00:12:08: then for the residential.
00:12:10: There is a residential and then restricted residence yep So its Jukyo Chiki in Japanese And Senor Jukyō Chiki which is The Restricted Residential.
00:12:19: In many wars like Setagaya Meguro generally they put additional restrictions on weekend only or school holidays Only.
00:12:27: in Senyor Chiki The Restricting Residential?
00:12:31: Is Shinjuku currently those weekend only restrictions in the restricted residential areas?
00:12:38: Do they even have a restriction?
00:12:41: Excellent question.
00:12:42: I do not know the answer, um i see...I didn't even know those terms right.
00:12:47: so and should I...?
00:12:49: I don't know..I'm...I outsource all of that.
00:12:53: Can I get a license?
00:12:54: yeah!
00:12:54: That's it.
00:12:55: can you get a licence or
00:12:56: no?!
00:12:56: I outsource ALL OF THAT to my She-Horseshoe sheet.
00:13:01: All I know is what one of my particular properties, actually don't know.
00:13:05: What particular zone that's...I've got two Shinjuku Properties One That's Completely Commercial and yeah the one thats completely commercial And one Thats a Weekend Only and i dont' Know what Zone that Is as well?
00:13:28: There are some addresses, there's some zones that you won't even get a license anyway.
00:13:33: So I don't know what it is in Shinjuku Like I know in Shibuya.
00:13:39: if your'e pure residential like Don't Even Apply You Won'T Get A Weekend Only License.
00:13:47: Or If It'S Close To School Within Hundred Metres Of The School You WON'T GET A LICENSE.
00:13:52: Oh!
00:13:52: You'll only get school holidays.
00:13:54: What's the point?
00:13:56: This
00:13:56: is kind of a variation on the theme that we've been feeling with the visas, how you know all foreigners get lumped together with the misbehaving tourists.
00:14:04: So in your case it's all hosts gets lumped Together With The Bad Actors right?
00:14:08: Correct correct and so what...so obviously my voice Is no one wants to hear from.
00:14:16: You Know this face?
00:14:19: Or you know No One will really care about My little business.
00:14:28: I've reached out to the Minpaku Association, which is like a Japan-wide association.
00:14:44: And I'm waiting to hear back, see what their plan is.
00:15:02: you know, hopefully they'll have be able to lobby a little bit better than I do.
00:15:10: i'm gonna support them however I can.
00:15:13: um so that and-and...I've said this for a while!
00:15:17: And I'd actually said this to airbnb and booking dot com.
00:15:20: Um..that They're missing in a massive PR opportunity by not telling the good stories like instead of just sort of hiding, you know and hoping to be under the radar a little bit.
00:15:33: it's like come out and be loud and proud.
00:15:35: Like what we're doing?
00:15:38: We are bringing hot...like good hosts or businesses giving tourists an excellent view of Japan, they're coming more than once.
00:15:47: They are importing new money which of course Japan needs and all the knock-on effects by buying properties that no one else wants... The reason I've got properties is Japanese people don't want them so it would be empty if i wasn't exploiting them.
00:16:06: And then there's a knock on effect as well with community aspects like airbnb and booking.com, their names and contacts for many small mum-and dad Japanese owned businesses Small shops Noodle shops Yakiniku shops Bakeries who appreciate the business that I send them And so they need to have those voices heard.
00:16:38: So of course Neighbours have absolutely like...I don't want An unruly Airbnb next to me.
00:16:45: I don't want that living next to Me, i get it.
00:16:47: So there's a couple of things That are at play here.
00:16:50: It's like teach the hosts how and the guests How To behave but also show The benefits Of you know having You Know Having this bit these businesses in in the small little suburban areas.
00:17:06: The
00:17:06: people who are educated properly then go out to their next destination, whether it's Kyoto or Osaka what have you?
00:17:11: and they already know how to behave because they got that crash course from the host right?
00:17:16: Correct!
00:17:17: And my guess is... They want that information, they want to be respectful.
00:17:23: They want to good right?
00:17:25: I mean That's who i attract of course with my marketing etc.
00:17:29: like if you're looking to party If You're Looking To Be A Yahoo!
00:17:32: Thats Fine Go You But Just Don't Book My House.
00:17:35: There Is Plenty Of Places Where I Can Direct You That Will Be More In Line With What Your Looking For.
00:17:40: Everyone Has Got Different Travel Goals.
00:17:42: I get it thats fine but trying bunch of, you know university students into a community.
00:17:54: That doesn't make sense either.
00:17:56: so yeah it's very complicated is very nuanced but and online at the moment it's more like Airbnb.
00:18:04: bad let's get rid of them ,you know there's a whole scourge .
00:18:08: It's just that it's frustrating because opinions are like assholes everyone has got.
00:18:19: But I'm just trying to... First of all, my owner who is in Shinjuku-ku was likely to be affected.
00:18:29: He's a little nervous, of course and i don't know how make him feel better because he has invested a lot.
00:18:41: He bought a house, spent a shed tonne on the renovation.
00:18:45: it looks fantastic!
00:18:47: It's doing really well even though it's weekends or monthlies, because he works with me.
00:18:53: And I've been able to maximise you know... He came to me after he realised that was weekend only and i was like dude okay let's make this work.
00:19:01: so we have made it work!
00:19:02: It has been a year down the line.
00:19:06: his yields had been excellent.
00:19:09: So here is happy as a plan.
00:19:14: we've had no trouble with the neighbours, I have had no questions from the ward office.
00:19:18: Nothing!
00:19:20: And my guests always thought they trashed correctly and everybody's happy so...

00:20:19: interesting tidbit in one of the articles, and I posted this which is numbers that I haven't seen before, but i've always been interested in it says so there's three thousand seven hundred and forty nine uh minpaku airbnb facilities in shinjuku ward.
00:20:36: sixty-three percent are run by japanese operators twenty-three percents by chinese and six percent by south korean.
00:20:47: right.

00:20:58: My business is a Japanese business right?
00:21:00: I'm a GK and registered LLC.
00:21:04: would the IB counted as a Japanese operator?
00:21:07: that's one thing i was looking at going.
00:21:09: hmmm...i am interested to see because if they say it's operated by Chinese That's interesting Because how do they know that?
00:21:21: It's a Japanese entity Generally a Japanese entity that runs it.
00:21:25: So I'm curious where they got those numbers, but in any case But
00:21:27: for Minpaku It doesn't have to be a corporate entity?
00:21:30: It might be an individual right
00:21:33: correct And also the total number.
00:21:35: so there's and also this different levels of minpaku as well.
00:21:38: There's like there's like the owner occupied which will not be affected by the way.
00:21:43: So if you live in the same building That you or the same If your gym in here is listed If you are an owner operator, and so you rent out one of the rooms in your house.
00:21:55: You won't be affected even if you're... In the middle of residential?
00:22:00: This is mainly for people who have a non-resident type of license And I haven't seen what their Rior Khan situation will either.
00:22:12: So that's not clear.
00:22:13: Well, I don't think Ryokan will be impacted.
00:22:15: Even though it's a Minpaku Shukuhaku like Ryokana because there is the life even though its a Ryokane license.
00:22:25: It classed as a step up from Minpakku right?
00:22:30: No so just you guys know but my background in this although i do real estate sales now.
00:22:39: So I had about twelve properties that were running on Airbnb and booking.com, doing the short term stays in pre-regulation.
00:22:49: so this was like up
00:22:52: until... Up until twenty
00:22:53: fifteen to twenty eighteen?
00:22:55: And then I had twenty eighteen new regulations came which is these zoning restrictions.
00:23:01: So i have get rid of about six properties because they went from hey could do it too can only due weekends or school holidays.
00:23:11: So okay I got rid of a bunch and then later because of COVID, i ended up getting rid of all of them.
00:23:18: And now just do sales...I'm not into the short-term stay.
00:23:24: But you've got long term tenants
00:23:27: in there right?
00:23:27: Yes but they're regular leases.
00:23:30: Regular
00:23:30: Chintamia!
00:23:30: Yeah
00:23:31: so yeah..but I was heavily involved at one stage in the short terms day market.
00:23:37: very personally I have experience with that and the regulations.
00:23:41: And i did a lot of the registrations myself, and the regulation changes in my self.
00:23:45: so... ...I'm quite familiar With A LOT OF THE REGULATIONS AND WHAT THEY'VE DONE AND WHAT they've implemented.. ..and the intentions behind it because I was heavily involved when They first put It IN!
00:23:54: And Shinjuku Ward How it's structured is.
00:24:00: there are commercial areas Residential Areas and then Restricted residential Areas And alot Of The Wards.
00:24:08: So Japan Governments federally put a requirement, sorry maximum of one hundred eighty days on bookings that you
00:24:20: can have.
00:24:21: Minpaku license holders.
00:24:22: and it's not a minpaku licence its a minpakku registration.
00:24:26: this is what slightly different um a min paku short like is... You register the property just to registration whereas an in order yohkan is a license.
00:24:40: So it's bit different.
00:24:43: and the Minpaku registration that you do, depending on the ordinance.
00:24:49: so even in Shinjuku Ward if its restricted residential area or in Setagaya Hoshibuya there are... On top of one hundred eighty day federal rule each local ward can implement their own rules.
00:25:05: Setagaya-ku, set in restricted residential areas.
00:25:08: You can only do weekends.
00:25:09: so was it Friday to Sunday?
00:25:12: Setagay is Friday to Monday.
00:25:15: yeah they don't include Sunday night but then they do include public holidays.
00:25:19: okay
00:25:20: which is a beast to try and manage your calendar for.
00:25:23: Yeah its restrictive in that regard.
00:25:26: Shibuyaku has school holidays Right
00:25:30: in.
00:25:31: well, it depends
00:25:32: in the restricted residential area and a
00:25:34: restrictive residential.
00:25:35: Absolutely or there's some in Shibuyoku that you just cannot do at all.
00:25:40: so
00:25:41: No really?
00:25:41: Yeah There are some streets where you can not Do any.
00:25:45: yeah even if you apply no
00:25:47: okay interesting Meguroku just has like doesn't allow it
00:25:53: strict.
00:25:54: Up until now, Toshimaku is tightening and then Shinjuku will probably be the first I guess.
00:26:03: Yeah Shinjukuku has had until i think now...I was just checking online while we were talking restricted residential areas where weekend only so Friday to Sunday.
00:26:23: Now they're expanding that to be banned completely.
00:26:26: And I don't know if it's just restricted residential or any type of residential area.
00:26:31: now where That differs from the ryokan, are the hotels?
00:26:36: is there your kind of hotels?
00:26:37: They were never allowed to operate in restricted residential areas.
00:26:41: Correct their only commercial zones.
00:26:43: yes exactly
00:26:44: commercial or The a certain type of residential area.
00:26:48: I think it's quasi-industrial
00:26:50: mixed zone, yeah oh
00:26:51: so anything beyond commercial and industrial permits everything below it right?
00:26:57: So an industrial area which has like very little restrictions can also have residential in there.
00:27:02: um It becomes less and less restrictive.
00:27:06: The restricted residence.
00:27:09: sorry the Ryokans could never operate in restricted residential So I don't think they're not going to be affected.
00:27:16: and again, there are license.
00:27:17: They're not a registration mm-hmm Yeah
00:27:22: And their attached.
00:27:23: so they're attached too.
00:27:24: i've got a couple of your kind licenses and they're attach two the The operator or the owner.
00:27:33: um yeah sorry
00:27:37: I thought it was a combination Of that property with that owner?
00:27:42: Yeah I've got one where i live in the property.
00:27:48: um and so that's my, the license is attached to me.
00:27:52: And then I have some other real-kind licenses in different coups where they're attached to their management like my company not the owner of the building.
00:28:04: So but I do have to designate a person within a certain radius.
00:28:14: Who is admire
00:28:15: you people and how?
00:28:16: You deal with all of that bloody red tape.
00:28:19: I
00:28:19: know it's always you take the boxes, right?
00:28:21: so II also operate like a ryokan in A building where i'm really Really good friends With the owner.
00:28:28: now she has agreed to be The designated call Like person-to-call if there are any problems And she lives In the same Building and There's another one That I have.
00:28:39: Where again I Have a Person that I Know who lives in the building next door and I've assigned to them, the responsibility.
00:28:49: And that's even though my office is a long way away... The fact that i have a designated person to do what like the kind of gaseous stuff or be on alert satisfies the restrictions.
00:29:12: What the statute says then it's fine.
00:29:15: and that even if that is designating a person who was not Belonging to your company, but who is the responsible?
00:29:22: Person as the because Japan loves there.
00:29:25: You know The deniability.
00:29:26: or like someone two point-two in between.
00:29:29: Um the middleman yeah As long as you've got that Then you meet their criteria of the
00:29:34: until they change at the criteria
00:29:36: Until I changed the criterion then we have to pivot.
00:29:38: so But my goal is to not cause trouble, it's just know what those laws are and do what I need.
00:29:51: bad actors have just gone, well I've got the license now.
00:29:53: I'm going to do whatever i want and then they ignore like... They had complaint.
00:29:57: after complain after complaint The police called.
00:30:01: or if someone from the ward officer calls you take action immediately.
00:30:07: You don't just thumb your nose at it.
00:30:09: That's why some of the operators are being shut down.
00:30:12: is because It hasn't been one issue but a repeated issue Of problems that has been ignored.
00:30:22: The the city hall just gets jack of it.
00:30:24: It's like well, you know You're not following their rules here?
00:30:26: You know you lose.
00:30:27: but if you take action then That that's the way to you know To be a good actor right?
00:30:34: hmmm you can't help any.
00:30:37: we can stop problems.
00:30:39: So all he can do is have systems in place to manage those as soon as they happen and to satisfy You know satisfy the law.
00:30:47: I kind of look at from the other perspective.
00:30:49: And when I had my Airbnb properties and was looking for them, one thing that's always careful before is to make sure it's in a street or an area which doesn't have direct neighbors but more of a commercial district not so residential because even though i tried to operate as best as i could , i knew people walking down a residential street looking for an apartment late at night in a foreign country.
00:31:24: With noisy suitcases?
00:31:25: It's alarming,
00:31:25: no I agree!
00:31:26: I'm hundred percent on the same page with you.
00:31:29: Yeah
00:31:29: and so like...I do feel that when we have what three thousand properties And thats anywhere from two to eight people staying.
00:31:38: So even if we're doing average of yeah three or four people Right That is per night What are we learning?
00:31:44: fifteen, twenty thousand people um yeah extra and so by thirty that's what five hundred thousand?
00:31:52: Is that a mathematical math question?
00:31:55: Yeah with this one as opposed to my gripes with the visa issues in the PR.
00:31:59: With this one I'm kind of very easy to understand where they're coming from.
00:32:03: no i agree
00:32:06: absolutely agreed.
00:32:07: there are some pretty pretty shocking examples
00:32:11: out.

00:39:58: So From Twenty Eighteen To Twenty Twenty We Built Up Again.

00:40:02: Airbnb Emptied Out Overnight Like The Platform Was Blank
00:40:08: Overnights And I've Lived Through That.
00:40:10: They Did Nothing to Help.
00:40:12: They Did Zero They Did Jack Shit.
00:40:17: Yeah, do you have faith in Airbnb responding to this with any
00:40:21: level?

00:40:24: I expect zero support.

00:40:28: and then pandemic hit again when i lost a million dollars in three weeks like there was... There were zero support as well.

00:40:43: I think it's like you said, their policy basically hey let's fly under the radar and do some lobbying rather than advertise the good stuff.
00:40:52: And they're missing a PR opportunity!
00:40:55: They really are because there are plenty of businesses that have reputable long-term non-foreign businesses like Japanese mum and dad noodle shops for example.

00:41:19: I've got a lot of really friendly... you know businesses in my area where I walk in the door and, You know i think i've told this story before a little yaki tori man.

00:41:34: it's like okay but because he is right next door at one of my places then he's open late And I always send people there and he's grateful so...
00:41:42: So they're just going too..I think This Is Going To Push People Out Like These Operators out Of The Residential Areas.
00:41:51: The issue that I think is a bit, that stings.
00:41:57: And again which is why i wish they implemented this before rather than now Is the people have bought and invested according to the rules?

00:42:09: Yeah Now they're changing the rules and now hold on...I've just bought a property.
00:42:13: I spent you know half million dollars or a million dollars on a property Getting it ready setting up This my investment from it and that's the part really I think is things, catching a lot of people in same way.

00:42:34: People were operating by rules for decades trying to operate changed the rules.

00:42:45: it's sixty three percent of Shinjuku Minpaku is around by Japanese.

00:42:52: Like they need to be...you know..like there gonna be effectiveness not just us right!
